Any idea what’s wrong with the previous one?

I guess its a generic one that doesn't support Dpf regens or certainly not on x5 e70's which need the valve to close partially to raise the temp in the dpf to burn off soot, googling suggests its a common enough issue but as no warning comes up without a code reader you wouldn't know and by the time you do the window for returns has closed and feedback has been left. Its main function seems to be to close on shutdown for to stop judder due to compression as the engine stops , it probably is doing this but id have needed someone to watch it to see as it opens as soon as engine stops so I wouldn't have time to get back round.
I wish aftermarket companies would charge a fair price for items that actually work and should be better regulated to see it does work, this one was too cheap but clearly not much use in my case. :headbang:

Yes I did its still in the return window so went back yesterday , I pretty sure these sellers know these don't work by now but as it doesn't put a light on the dash most wont realise (as you need a code reader to find out ) untill well past the return date .Maybe they work for some models but the x5 e70 doesnt appear to be one of them .
Getting parts that don't work or partially work makes fixing stuff a lot trickier , and the x5 will struggle on with a blocked dpf if its gets the odd good run to allow a passive regen where if its gets hot enough it will partially clear itself just enough to keep going.
I noticed ages ago my throttle valve would whirr away for ages if you had the bonnet up and opened a door etc.

Handy still in the return window.
Trusting the likes of eBay parts is a gamble and personally i would go second hand genuine first i know that is a gamble as well.
A used part will work or it won't and that is that unlike your part that you might have thought worked if you had no scanner.
Glad you got it sorted out and are getting a refund on the other one.

The used ones of these all suffer the same problem I believe ,oil gets in them over time and destroys the electronics which is why I avoided a used one this time plus the age of these cars now the parts will have covered a huge mileage , a car breaker will say all their parts are good until you prove otherwise and without a code reader you still wont know if its actually regenned or not depending on the length of your runs.If I hadn't done a few short runs back to back over several days it would have struggled on nearly full all the time which going by last regen 3000 miles ago is whats been happening.

I'm glad its sorted too between the stats which only seem to last 5 years or so and throttle valve its cost £300 in parts alone, dealer would have probably wanted to fit a new dpf  With 2 injectors 6 months ago (£600) which I couldn't get anybody to do and now this if I couldn't do it myself it would have been scrapped . Its just at the mileage where a lot of stuff is worn out.
Any oe stuff on ebay has been mint to be fair , I always look for mahle or lemforder for suspension parts ,this is the first non oe part I tried to save money on , I will stick with oe where possible but ebay has made the return easy when things don't work out

If the aircon now works again with a regas I will be happy :driving:

I dropped a 7mm Allen key down the back on my old e46 320d doing the air filter.
About 4 years later it was found just poking out of the under tray.
What got me was it was a new set i had only just bought with the wobble ends.
I gave what was left of the set to my nephew as no good to me with that one missing then bought a second set lol.

Its a black hole in there lol

I have to say the soft stop once you press the stop button is noticeable now the throttle valve is fully working ,before it was a strong judder it it stopped rotating under compression, this is perhaps the easiest way of diagnosing a faulty valve
